Former Marine charged with assaulting police officers in Capitol riot says he was ‘caught up in the moment’

A man who is being charged with assaulting police officers while storming the Capitol told federal investigators that he “got caught up in the moment.”

Barton Shively, who is a former Marine and a Pennsylvania resident, was arrested on Tuesday and is facing several charges including civil disorder, forcibly assaulting, impeding or interfering with any federal officer or employee and violent entry into restricted grounds or any Capitol building, for his alleged involvement in the violent riots that happened at the Capitol on Jan. 6, according to CNN.

The news outlet reported that recently unsealed court documents revealed an FBI bulletin with photos of people who were at the Capitol during the riots and an FBI tip that identified Shively as one of the people pictured.

Shively reached out to local police and confessed that he was at the Capitol and that he wanted to self-surrender. In an interview with the FBI in Pennsylvania, he admitted that he “got caught up in the moment,” when he grabbed a police officer by his coat, CNN reported.

Federal prosecutors also provided a video of Shively allegedly shoving a police officer. Assistant US Attorney Scott Ford said that was not the only instance of Shively assaulting an officer.

“His charges are different than the majority of the people that were down in DC. He didn’t just enter the Capitol unlawfully, he actually laid hands on police officers on three separate occasions,” said Ford, according to CNN.

Shively has not yet entered a plea and has since been released from custody, CNN reported.
