Appeals court rules against New York soda ban
Mayor Michael Bloomberg had tried to ban certain businesses from selling sodas and other sweetened beverages larger than 16 ounces.
{mosads}The appellate division of the state Supreme Court said Tuesday that the ban on large sodas was an overreach, upholding an earlier court ruling that blocked the ban from taking effect.
The city’s Board of Health “overstepped the boundaries of its lawfully delegated authority” by imposing the portion cap, the appeals court said.
