Liberty had also challenged the provision in the healthcare law requiring most employers to include contraception in their employees’ healthcare plans without charging a copay or deductible.
The appeals court said it could not rule on that challenge, in part because Liberty raised it late in the process while similar challenges are working their way through courts across the country.
