OpenAI seeks to dismiss parts of New York Times suit
OpenAI, the company behind the popular ChatGPT artificial intelligence (AI) tool, filed this week seeking to dismiss key elements of a lawsuit brought by the New York Times.
In the filing in the Southern District of New York, OpenAI argued that ChatGPT is “is not in any way a substitute for a subscription to The New York Times” and asked a judge to toss the lawsuit, our colleague Dominick Mastrangelo reported.
In a lawsuit filed in December, the Times argued OpenAI, through its training of ChatGPT, is effectively stealing billions of dollars worth of work by its journalists and poses a threat to the newspaper.
“In the real world, people do not use ChatGPT or any other OpenAI product for that purpose,” the filing said. “Nor could they. In the ordinary course, one cannot use ChatGPT to serve up Times articles at will.”
The Times’s lawsuit could set a precedent over copyright claims of media companies during the age of advancing AI.
