Giuliani threatens to go to court if Mueller subpoenas Trump

Rudy Giuliani on Saturday threatened to take special counsel Robert Mueller to court if he attempts to issue a subpoena against President Trump. 

“If Mueller tries to subpoena us, we’re going to court,” Giuliani said in an interview with ABC News. Giuliani, a former New York City mayor, joined Trump’s legal team in April.

Giuliani’s warning arrived just hours after The New York Times revealed that Trump’s lawyers sent Mueller a 20-page letter in January arguing that Trump couldn’t obstruct justice because he has unfettered authority over all federal investigations.

The confidential letter obtained by the Times argues that the Constitution gives the president the broad authority to, “if he wished, terminate the inquiry, or even exercise his power to pardon.”

Though the letter predates Giuliani’s involvement with Trump’s legal team, Giuliani verified its contents to ABC News, adding that the legal strategy the letter outlines still stands. 

The Times was the first to report on the existence of the letter, although the president appeared to foreshadow the newspaper’s scoop minutes before it was published on Saturday. Trump questioned whether Mueller’s office or the Justice Department had leaked his legal team’s letter to the media.

“There was No Collusion with Russia (except by the Democrats),” Trump tweeted shortly before the Times story was published.

“When will this very expensive Witch Hunt Hoax ever end? So bad for our Country. Is the Special Counsel/Justice Department leaking my lawyers letters to the Fake News Media? Should be looking at Dems corruption instead?” 

Like Trump, Giuliani also accused the special counsel of leaking the memo, telling ABC News that Mueller should have released a statement condemning the Times’s report and suggesting the special counsel should investigate his team in response to the letter’s publication.
