Romney ad yanked from YouTube over copyright claim
{mosads}The Romney campaign told the Huffington Post Monday that its use of Obama singing was fair use — a provision of copyright law that excepts use of copyrighted material for commentary and criticism. While the campaign is likely to prevail, the process established under the Digital Millennium Copyright Act puts a strong burden on the Romney campaign to establish its ability to use the song — and it could be weeks before the ad reappears on YouTube.
Interestingly, as noted by the Daily Caller, BMG is owned by Bertelsmann AG, the same conglomerate that owns Random House — the publisher of President Obama’s books.
